These Terms of Use form a binding contract between you and BFF Labs, Inc. (referred to here as "EXO", "we", "us", or "our"). They govern your use of EXO's website and web application and any content, features, or services we may add in the future (collectively, the "Service"). By creating an account or otherwise using the Service you accept these Terms on your own behalf and, if applicable, on behalf of any organization you represent. If you do not agree, do not use the Service.
The Service is intended to help you explore information about your fitness but it is not a regulated medical device, has not been cleared or approved by the U.S. Food and Drug Administration, and cannot substitute for professional medical care. Always seek the advice of a qualified health-care provider before making decisions about diagnosis, treatment, or medication. If you believe you have an emergency, call 911 or the equivalent in your region.
Outputs generated by the Service are probabilistic; they may exclude relevant facts, misinterpret your data, or otherwise be inaccurate. The Service, including all software and content, is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Without limiting the foregoing, we disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and accuracy. Your use of the Service, and any reliance on content it produces, is solely at your own risk.
Except for third-party materials that retain the ownership of their respective holders, every element of the Service, including but not limited to software, text, graphics, and designs, is owned by EXO and protected by intellectual-property laws. You receive a limited, non-exclusive, revocable license to access the Service in accordance with these Terms. All rights not expressly granted are reserved.
You may supply data to the Service, including but not limited to workouts, exercise and fitness logs, nutrition entries, sleep notes, lifestyle or well-being entries, text prompts, and files ("User Content"). By submitting such data you (a) confirm that you have all necessary rights and consents; (b) grant EXO a worldwide, non-exclusive license to store, process, and transform the User Content solely for the purpose of providing, maintaining, and improving the Service; and (c) agree not to submit content that is illegal, harmful, or infringes the rights of others. You must not rely on the Service for time-critical clinical decision-making or emergency triage.
We may suspend or terminate access to the Service, or remove specific User Content, at our discretion if we believe you have violated these Terms or our policies, or if necessary to protect the Service or its users.
To the maximum extent permitted by law, EXO shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits or revenues, whether incurred directly or indirectly, arising from or related to your use of or inability to use the Service.
You agree to indemnify and hold harmless EXO, its officers, directors, employees, and agents from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of or related to your misuse of the Service or violation of these Terms.
Any dispute arising under these Terms or relating to the Service shall be resolved by binding arbitration in San Francisco County, California, pursuant to the Commercial Arbitration Rules of the American Arbitration Association. You and EXO waive the right to participate in any class, collective, or representative proceeding.
We may update these Terms from time to time. If changes are material, we will post written notice before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions.
